Remote work in Spain – Overview

Spain is considered a friendly country to live and work remotely in. With rich culture, reasonable weather, a strong tourism economy, and a relatively low cost of living, Spain is something of a destination country for remote workers. For employees seeking to get a working visa to Spain, the process can be difficult (but not impossible) if they are not from a country in the European Union; however, the legislative body of Spain recognizes the value that remote workers can bring to Spain in terms of dollars spent, so they passed a law as the pandemic was winding down to make it easier for people to do remote work in Spain.

Remote work in Spain – Laws & Regulations

Before 2022, remote work in Spain was slightly more complicated. For example, if someone spends more than 183 days in Spain, they are considered a tax resident and must pay taxes in the country.

In 2022 however, Spain passed a law related to remote work in Spain which allowed workers to live and work remotely in Spain for up to 3 years. The Spain digital nomad law allows people to apply for a 12-month visa, renewable up to 2 times. The biggest benefit of this law would be a reduced non-resident tax rate of only 15% for remote workers in Spain (rather than the normal 25%), as well as provisions allowing close family members like children or spouses to be eligible for visas.

To be eligible to take advantage of the Spain digital nomad visa, applicants (from outside the European Economic Alliance, which in this case does not include the UK) must prove the following:

  • That they have worked remotely for at least a year.
  • That the work can be carried out remotely.
  • If they are under contract to a company, that they have had a professional relationship with the company for at least three months and that the company permits remote working.
  • If they are freelance, that they work with at least one company outside Spain and provide the terms and conditions of the remote work. Note that their clients cannot exceed 20% of their total business.
