The primary law for remote work in Italy is the “Lavoro Agile” law, Law No. 81/2017. This law is designed to promote balance between private life and work and to enhance competitiveness in businesses. Key legal requirements for employers to consider, include:

  • Written Agreement —according to the law, remote work must be regulated by a written agreement between the employer and the employee. This agreement can be part of the employment contract or a separate agreement, and it can be revoked by either party with a notice period typically set in the agreement.
  • Working Hours — the law allows for flexibility in terms of working hours and location. Workers have the right to stop work for periods of rest and have the right to disconnect outside of their working hours.
  • Equal Treatment — remote workers must be treated the same as other workers in terms of pay and benefits. They should have the same access to training and career opportunities.
  • Health and Safety — employers are responsible for the health and safety of their remote employees, including work-related injuries that occur at home, just as they would be for injuries occurring at the workplace. Employers must inform remote workers about the company’s safety policies and the proper use of work equipment.
  • Privacy —employers are obliged to respect the privacy of their remote employees and to protect their data according to the data protection laws.
